Charging standard for real estate appraisal

Price bureaus (committees), construction committees (construction departments) of provinces, autonomous regions and municipalities directly under the Central Government, and real estate administrations of Beijing, Tianjin and Shanghai:

In order to regulate the charging behavior of real estate intermediary services, safeguard the legitimate rights and interests of the parties involved in real estate intermediary services, and establish a normal market order for real estate intermediary services, the relevant issues concerning the charging of real estate intermediary services are hereby notified as follows:

1、 Any real estate consulting, real estate price evaluation, real estate brokerage and other intermediary service institutions established according to law and qualified as real estate intermediary can charge the client reasonable fees for providing intermediary services related to real estate development and investment, business management, consumption and other aspects for enterprises and institutions, social organizations, other social organizations, citizens and foreign parties.

2、 Real estate intermediary service charge is an important operational service charge in the real estate trading market. The intermediary service institution shall, on the principle of reasonableness, openness, honesty and credibility, accept voluntary entrustment, and both parties shall sign a contract. The intermediary service institution and the client shall negotiate to determine the intermediary service fee in accordance with the charging methods and standards specified in this Circular.

3、 The charging system of real estate intermediary services shall be clearly marked. Intermediary service institutions shall publish their charging items, service contents, charging methods, charging standards and other matters in a conspicuous place at their business premises or places where fees are paid.

When accepting the entrustment of the party concerned, the real estate intermediary service agency shall take the initiative to introduce the price and service content of the intermediary service to the party concerned.

4、 The real estate intermediary service agency may, at the request of the client, provide consulting services related to real estate policies, regulations and technologies, and collect real estate consulting fees.

The real estate consulting fee is divided into oral consulting fee and written consulting fee according to the service form.

The oral consultation fee shall be negotiated by both parties according to the time required for the consultation service and the professional and technical level of the consultants.

The written consulting fee shall be calculated and charged according to the technical difficulty, complexity and simplicity of the consulting report and the size of the subject matter. Ordinary consulting report, 300~1000 yuan per copy; For the consulting reports that are technically difficult, complex, and consume more personnel and time, the charging standard can be appropriately raised, which generally does not exceed 0.5% of the amount of the consulting object.

The above charging standards are indicative reference prices. The actual transaction fee standard shall be negotiated between the entrusting party and the intermediary.

5、 The fee for real estate price evaluation shall be charged by the institution that has the qualification for real estate evaluation and has been confirmed by the real estate administrative department and the price department according to the prescribed fee standard.

The real estate price evaluation fee, which is dominated by real estate, shall be calculated and collected according to the total price of the real estate at a fixed rate of difference and in a progressive manner. See the attached table for specific charging standards.

The charging standards for land price evaluation shall be implemented in accordance with the relevant provisions of the Notice on Land Price Evaluation Charges issued by the State Planning Commission and the State Land Administration.

6、 The real estate brokerage fee is the commission charged by the professional real estate broker for brokerage. The real estate brokerage fees are charged according to different agency projects.

The house leasing agency fee shall be calculated and collected in a lump sum according to the standard of half a month to one month transaction rent, regardless of the length of the lease term.

House sales agency fees shall be charged at 0.5~2.5% of the total transaction price.

In case of exclusive agency, the charging standard shall be negotiated between the entrusting party and the real estate intermediary agency, which may be appropriately raised, but the maximum shall not exceed 3% of the transaction price.

The methods and standards of agency fees for the transfer of land use rights shall be separately prescribed.

The real estate brokerage fee shall be collected from the client by the real estate brokerage agency.

7、 The real estate price evaluation and real estate brokerage fees stipulated above are the maximum standards. The administrative departments in charge of price and real estate in all provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with this Circular, formulate local specific charging standards and submit them to the State Planning Commission and the Ministry of Construction for the record. The charging standard for special economic zones may be set higher, but the maximum shall not exceed 30% of the above charging standard.

8、 All regions, departments and real estate intermediary service agencies shall strictly implement the charging principles and standards stipulated by the price department, and earnestly provide services commensurate with quality and price.

Any intermediary service agency whose qualification should be confirmed but not confirmed, or who charges fees arbitrarily under its own name, or raises the charging standard without authorization, or formulates or adjusts the charging standard beyond its authority, shall be punished by the price inspection agency according to relevant laws and regulations.

9、 In case of any conflict between the relevant provisions before the issuance of this Notice and this Notice, this Notice shall prevail.
